The following terms and conditions (“Terms”, “Agreement”) govern all use of LOCKED mobile applications (the “App”), and all information, content, services and products available at or through them (collectively ” LOCKED ” or the “Service”)
Accepting These Terms
1.1 By accessing and/or using any part of LOCKED, you agree that you are entering into a legally binding agreement with us. You also agree that these Terms of Service govern your access to and use of the Service.
1.2 Your access to and use of the Service is conditioned on your acceptance of and compliance with this Agreement. By accessing or using any part of LOCKED you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this Agreement, you may not access the Service.
License Agreement
2.1 LOCKED grants you a limited, non-exclusive, non-transferable and revocable License to access and use the Service. You may only use the App on a device that you control and that is permitted by any applicable usage rules applied by your device’s manufacturer or by the marketplace at which we have made the app available. The terms of this License will also govern any upgrades provided by LOCKED that replace and/or supplement the original App, unless such upgrade is accompanied by a separate license, in which case the terms of that license will govern.
2.2 However, your right to use the Service does not include any of the following, which is explicitly prohibited when using the Service:
(і) using the Service other than for its intended purposes or in any way that infringes any of the terms and conditions of this agreement;
(іі) using any data mining, robots or similar data gathering or extraction methods, downloading (other than page caching) of any portion of the Service or any information contained therein;
(ііі) attempting to access areas/features of the Service that you are not authorized to access;
(іv) any activity that will compromise the security of the Service;
(v) reverse engineering or access to the Service in order to build a competitive product or service;
(vі) using the Service in any manner that could damage, disable, overburden or impair the functioning of the Service in any manner;
By using or accessing the Service you agree, represent and warrant not to do any of this. In case of non-compliance, we may terminate your use of the Service. In case of infringed copyright and other rights of LOCKED or third parties, you may be subject to prosecution and damages.
Intellectual Property Rights
3. The design of LOCKED, including the texts, scripts, graphics, formatting, graphs, trademarks, service marks, logos, designs, look and feel, HTML, source and object code, format, queries, algorithms interactive features are owned by or licensed to LOCKED, subject to copyright and other intellectual property rights and the applicable domestic and foreign laws and international conventions. Any kind of reverse engineering and decompilation is prohibited.
Disclaimer
4.1 In case any competent government authority requests us to disclose any personal user identification information in accordance with relevant legal procedures, laws or regulations, we will provide such personal user information according to the requirements of the government authority or for the purpose of public safety. LOCKED will assume no liability for any disclosure in such case.
4.2 LOCKED will not assume any responsibility for any of your personal information that is disclosed for your own reasons (for example, when you voluntarily disclose to other people your password or when you share your account with other people).
4.3 LOCKED assumes no responsibility for any personal information that is lost, disclosed, or falsified due to forces beyond LOCKED’s control, including but not limited to events that may affect normal network operations, such as hacker attack, intrusion or attack of computer virus and temporary closure of websites due to government regulations or actions.
4.4 LOCKED assumes no responsibility when it or a third party uses your personal information in accordance with provisions of relevant laws or regulations or this privacy policy.
4.5 LOCKED assumes no responsibility when your personal information is disclosed due to unpredictable and inevitable risks of the internet, including without limitation: virus attack, hijacking, temporary site closure or server closure resulted from government control and inevitable technical defects of the software due to technical level at the time of development.
Costs
5. Download and usage of the App is for free. To finance the Service, we will introduce in-app purchase features or advertisement.
Service Eligibility
6. To be eligible to use the Service, you must meet the following criteria and represent and warrant that you: (і) are of legal age to form a binding contract with us. (іі) have full power and authority to enter into this Agreement and doing so will not violate any other agreement to which you are a party or any laws of any country to which you are a citizen or a resident or from which you are accessing the Service;
Severability
7. If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way.
